These Terms of Sale ("Terms") govern the purchase of CUBO machines, CUBOPods, and related accessories (collectively, "Products") from CUBO Beverages Inc. ("CUBO," "we," "us," or "our") through cuboclub.com or any authorized CUBO checkout page (the "Site"). By placing an order, you agree to these Terms. These Terms of Sale work alongside our Terms of Service and Privacy Policy, which govern your use of the Site generally.
Placing an order through the Site is an offer to purchase, which CUBO may accept or decline at its discretion — for example, if a Product is out of stock, if we suspect fraud, or if an order was priced in error. If we cannot fulfill an order after payment has been taken, we will notify you and issue a full refund of any amount charged for the unfulfilled portion.
You confirm that the shipping address, billing information, and business details you provide at checkout are accurate. CUBO machines are sold for commercial food-service use; if a listing specifies a particular use case or vertical, that description is illustrative and does not limit who may purchase.
All prices are listed in U.S. dollars and exclude applicable sales tax, duties, and shipping unless stated otherwise. Payment is processed securely through our checkout provider (Shopify/Stripe); CUBO does not store your full payment card details. We reserve the right to correct pricing errors at any time, including after an order is placed, and will contact you before charging a corrected amount.
Machines ship via standard freight/parcel carrier to the address provided at checkout. Estimated delivery windows shown at checkout are estimates only and not guaranteed delivery dates. Risk of loss and title to a Product pass to you upon delivery to the carrier, except where applicable law requires otherwise; CUBO will assist with filing a claim if a shipment arrives visibly damaged.
CUBOPods ship frozen, using dry ice and packaging sized to keep pods frozen in transit. Someone must be available to receive frozen shipments promptly — CUBO is not responsible for pod quality if a package sits unclaimed after a delivery attempt.
CUBOPods must be kept frozen at all times, at 0°F / -18°C or colder, and inserted into the machine while still frozen. If a pod thaws for any reason, it must be discarded and should not be inserted into the machine or consumed. CUBO is not responsible for pods that are mishandled or improperly stored after delivery.
Machines. You may return an unused, like-new machine in its original packaging within 30 days of delivery for a refund of the purchase price, less the original outbound shipping cost. Contact cubocare@cubopods.com to start a return; we'll provide a return authorization and shipping instructions. Machines returned damaged, missing accessories, or outside this window may be subject to a restocking fee or refused.
CUBOPods. Because pods are a frozen, perishable product, orders are final once shipped and cannot be returned for a refund except where a shipment arrives damaged, defective, or materially delayed due to a CUBO or carrier error — in those cases, contact us within 48 hours of delivery for a replacement or refund.
Order cancellations. You may cancel an order for a full refund any time before it ships. Once an order has shipped, the return terms above apply.
CUBO machines carry a one (1) year limited warranty covering parts and workmanship from the date of delivery. During the warranty period, CUBO will repair or replace, at its discretion, any machine or component that fails under normal commercial use due to a manufacturing defect. This warranty does not cover damage from misuse, unauthorized modification, use of non-CUBO pods, failure to follow cleaning and maintenance guidance, or normal wear items. To make a warranty claim, contact cubocare@cubopods.com with your order number and a description of the issue; see also our Tutorials & Troubleshooting guide before reaching out, as many issues can be resolved without a service ticket.
To the fullest extent permitted by law, CUBO's total liability arising out of any purchase is limited to the amount you paid for the Product giving rise to the claim. CUBO is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost business, arising from the purchase or use of a Product, even if CUBO has been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, and any dispute arising from a purchase will be brought in the state or federal courts located in Los Angeles County, California. (To be confirmed with counsel based on CUBO Beverages Inc.'s state of incorporation and preferred venue.)
